Our divorce decree states that the father pays $2300 a month in child support of minor children until the youngest reaches age of 18. No where does it say it decreases as each child reaches 18. It only states he pays that amount until youngest is 18.

As each child once 18 will spend 4-5 years in college and can't support themselves or pay their car insurance and car that I have pay for. Please clarify?

I feel bad you are going through this.

To get the correct answer, you will need to talk to the person/lawyer who drew up the decree to get the true meaning. I don't think anyone on any social media site can answer this except to guess and that would not be cool.

According to Social Security your ex wife will receive SS benefits sooner if you have a kid that is 16 years old below.

In my case, we have a 2yr old kid and I'm also paying a child support. Will my ex wife receive SS benefits at the same time with the child support?

You have not given sufficient information for anyone to even give information but, no matter the question, only Social Security can give you correct information as all cases are different.

Any SS benefits that your ex-wife and child can receive will be based on what type of SS you are presently on - disability? SSI? SSDI? All of these programs have different rules for allotting benefits.

Whether your ex can receive SS benefits and child support at the same time will be based on many things (total income of both parties/age of child/divorce degree/etc.
You should consult an attorney (after you visit SSA) as your support payments may change but it can only be done through the court.

Go to your local SSA with documentation - SS numbers for yourself and others if you have them / copy of divorce degree showing support amounts / or other documentation if you have it.
They will tell you if you need to submit anything else but this will get you started so you will know where you stand..

If you owe back child support that will also be something to discuss with an attorney.

I am trying to collect child support from my stepdaughter, but she's on SSI. I know they won't touch it, but she's also working. Will child support take payments from her work check even if she's on SSI? I have been raising her 7 year old son for his whole life with no help from anyone. Even the state won't help because I'm not his biological grandma.

I also have 3 children myself I don't know what else to do. She thinks this is funny and sent me a text when she received the paperwork saying, "Haha nice try, but I get SSI they aren't going to make me pay". I just don't know where else to turn.

Her SSI payments cannot be garnished. If she works, her check can. I would report this to Social Security. You could also contact the Legal Aid Society.

If your ex was awarded a settlement from disability and you were awarded all your back child support in court, can the child advocate take it upon themselves to half that money up with another child obligation even though you have a court ordered paper saying it goes to you?

This is a very serious Legal matter that can only be settled by an attorney as you have 2 "agencies" to deal with and only an attorney will know your rights in this case and it may have to go back to court to be settled.

Do not wait to take care of this as once that check is sent it will be more difficult to correct - if in fact you are entitled to the full amount.
Gather all of your paperwork and find an attorney ASAP.

The way I am reading the question, it seems to me that the disability settlement is being used to fulfill the back child support. If he has another child to support and the court did not know that at the time you were awarded the money, they could change their minds. The court always does what is in the best interest of the child. It would be better that both children have some money than one child has nothing. I would definitely consult an attorney on this. You could use the Legal Aid Society if you don't have the money.

It sounds like your husband has two obligations to pay child support. The only real way to settle this and find out if you can collect half the money is through a lawyer. They will need to file the papers in court for you.

I know a person who was owed back child support and she received his income tax returns until it was paid. I don't know the details in how this worked or what her lawyer did for her.
I would go and see my lawyer and find out your legal right. It will be up to the courts to decide the outcome in such a case.

Have you discussed this with your grandmother? Who supplied you with this information (is it reliable?)?
Are you sure your grandmother did not give someone else any of the money for your support? Was this support ordered through the court (maybe a divorce agreement?)? How was it decided that your grandmother would receive the checks? How old were you when support check started and ended? Could you be talking about Social Security benefit checks?

These are some on the questions you may be asked if you seek legal advice. You will need an attorney to try and recover any money paid in the past but you may also need proof someone actually received the money - and - if that person still has any money to pay out.
I would recommend talking to your grandmother first and also to the person paying the support and then decide how to proceed.

You need to do as cybergranny advised. You can not just tell the court or ss to send you a check for no reason. There had to be a court order of supporting evidence. Does she pay your insurance, or medical or school tution or other expenses? If so, she may be getting it for that reason. Is the person you live with under her POA? Maybe she manages their money and you are not aware of it. I work with a gal who is power of attorney over her daughters affairs per the court, because the daughter can not handle money (she is bi-polar and spends great deals of money). So, she gets her daughters paychecks, ssi and the childrens child support payments. In return, she pays all their bills out of that money. Her grandchildren are not aware of this, since it is a private matter involving their mothers health. There may be more to the story than you are aware of.

I'm not sure where the check came from. Is it from a non-custodial parent? Is it from Social Security? Are you not receiving necessities because that money is not being used for you? If you are living with your grandmother she is entrusted with the money. You could ask her to show you records of how the money was spent. I do know that if you are under age the money doesn't go to you directly.
